Why Does a Gym Need Its Own Insurance Policy?

Gyms and fitness studios carry a mix of risk a generic business policy rarely covers properly: members using heavy equipment daily, instructors giving hands-on physical guidance, high foot traffic through shared spaces, and a legal environment where signed waivers don’t remove liability the way most gym owners assume.

Coverscope works with 24-hour gyms, boutique studios, group fitness centres and multi-zone fitness complexes across Australia. Each carries a different mix of equipment value, instructor exposure and public foot traffic, and a policy built around a generic business template rarely reflects what a fitness business actually runs.

What Does Gym & Fitness Insurance Cover?

The most commonly included cover sections are as follows:

  • Public Liability: third-party injury or property damage on your premises, the cover most commonly required before a lease or client contract is signed.
  • Professional Indemnity: financial loss from negligent fitness advice or instruction, separate from a physical injury claim.
  • Property & Building: owned or leased premises against fire, storm and accidental damage.
  • Equipment & Contents: gym machines, electronics and fit-out against theft or damage.
  • Products Liability: claims arising from products sold on-site, such as supplements or apparel.
  • Business Interruption: lost income if the facility is forced to close after an insured event.

Who Needs Gym & Fitness Insurance?

Gym operators don’t need a specific industry licence to trade in most Australian states, but that doesn’t reduce the underlying liability exposure of running a facility where members exercise under instruction and around heavy equipment.

  • 24-hour and staffed commercial gyms
  • Boutique fitness and functional training studios
  • Yoga, Pilates and barre studios
  • Group fitness and class-based centres
  • Multi-zone fitness complexes with shared amenities
  • Personal training studios
  • Businesses employing instructors, trainers or contractors

We just had Grant at Coverscope provide us with a quote for our Strata insurance. He did it all over the phone with speed and efficiency and then fallowed up his verbal quote in writing and few minutes later. His written quote included pricing from various insurers that made comparisons easier. He didn’t hassle us and waited for us to call him back a few days later. He then answered all our questions and concerns relating to the quote. It really couldn’t have been any easier. We can recommend Grant and Coverscope.

Excellent experience with Daniel from start to finish. Quick, efficient, and easy to work with. We received our quote the same day, with multiple options, and saved a substantial amount compared to a larger provider while maintaining the same cover. Extremely grateful for the help.

Does a Signed Waiver Mean I Don't Need Liability Insurance?

No. Under section 139A of the Australian Consumer Law, suppliers of recreational services can limit liability for death or personal injury, but only with specific wording, and it can never exclude gross negligence, broken equipment staff knew about, or poor supervision. Fitness industry codes of practice also sit alongside this and vary in how binding they are from state to state, with the industry currently moving toward one national standard. A waiver reduces exposure, it doesn’t remove the need for cover.

What's the Difference Between Public Liability and Professional Indemnity for a Gym?

Public Liability responds to physical injury or property damage, a member tripping on equipment, for example. Professional Indemnity responds to a financial loss caused by negligent advice, such as a program design or nutrition recommendation that causes harm without a direct physical incident on-site. Gyms offering personal training or programming typically need both.

Are Independent Contractor Trainers Covered Under My Policy?

Usually not automatically. Contractors operating under their own ABN generally need their own Public Liability and Professional Indemnity cover, since a gym’s policy is written around its own operations and employees, not around a contractor’s independent advice or instruction.

Does a Standard Gym Policy Cover Unstaffed 24-Hour Access?

Not automatically. Operating with unstaffed hours changes the risk profile of the business, and insurers generally need to be told about it. Undisclosed operating models, including a shift from staffed to unstaffed access, can affect a policy’s validity, and some policies exclude unstaffed hours entirely unless specifically extended to cover them.

Gym & Fitness Cover Types Explained

Public Liability Insurance

Covers legal costs and compensation if a member, visitor or contractor is injured, or their property is damaged, as a result of the gym’s operations, provided the gym is found to have been negligent. This generally responds to broken equipment staff knew about, unsafe floors or poor supervision, but not to a member misusing equipment against safety instructions or accepting an obvious risk. A signed waiver can limit liability for some claims under the Australian Consumer Law’s recreational services provision, but it cannot exclude gross negligence, and fitness industry codes of practice sit alongside it with varying force from state to state. Operating with unstaffed 24-hour access changes the risk profile of the business and needs to be disclosed to the insurer, since some policies exclude unstaffed hours entirely unless specifically extended.

Professional Indemnity Insurance

Covers financial loss arising from negligent fitness advice, program design or instruction, distinct from a physical injury claim. This matters for any gym offering personal training, nutrition guidance or structured programming rather than open-floor equipment access alone. See our professional indemnity page for how this cover works more broadly.

Property & Building Insurance

Covers owned or leased premises against fire, storm, vandalism and accidental damage. Cover is usually arranged on a defined value or replacement basis, and specific terms depend on whether the building is owned or leased.

Equipment & Contents Insurance

Covers gym machinery, electronics and fit-out against theft or accidental damage. Fitness equipment is treated as “plant” under work health and safety law, meaning operators carry an ongoing duty to keep it safe and properly maintained, separate from the insurance question of what happens if it’s damaged or stolen. Standard cover responds to external events like fire, theft and accidental damage; mechanical or electrical breakdown from normal wear, a treadmill motor failing under regular use, for example, typically needs a separate breakdown extension rather than being assumed under standard contents cover.

Business Interruption Insurance

Replaces lost income and covers extra costs if an insured event, a fire or major equipment breakdown, forces the facility to close for a period. Many policies apply a minimum reduction-in-income threshold per event before a claim becomes payable.

Products Liability Insurance

Covers claims arising from a product sold or provided on-site, such as supplements, apparel or nutrition products, if the product causes harm or triggers a complaint after leaving the gym’s control. Public Liability generally responds to what happens on the premises, a member tripping over a dumbbell, for example, while Products Liability responds to what happens after an item leaves the gym’s direct control, which is why the two are separate sections rather than one broad cover.

Theft and Vandalism Insurance

Covers stolen or maliciously damaged equipment and fit-out. Most policies only respond to theft following forced or violent entry, cover for theft without forced entry is available but comes at a higher premium.

Glass Cover

Optional cover for internal and external glass, mirrors, windows and doors, relevant given how much glazing a typical fitness fit-out involves.

What Usually Isn’t Covered?

Exclusions, excess amounts and limits of liability vary between insurers, so always check the current Product Disclosure Statement (PDS) and Target Market Determination (TMD) before relying on a policy summary. Common exclusions include:

  • Wear and tear or gradual deterioration of equipment
  • Mechanical or electrical breakdown, unless a specific extension has been added
  • Injury caused by a member misusing equipment against posted safety instructions, or accepting an obvious risk of the activity
  • Claims arising from an independent contractor’s own advice or instruction, where the contractor holds no cover of their own
  • Gross negligence, which cannot be excluded by a signed waiver regardless of its wording
  • High-risk or undeclared activities not disclosed to the insurer, such as combat sports, swimming instruction, or outdoor bootcamps run in public parks
  • Unstaffed or 24-hour access not disclosed to the insurer, or occurring outside the hours a policy has been arranged to cover
  • Injury to the gym owner or to PAYG employees, which fall under workers compensation rather than public liability
  • Cyber incidents or member data breaches, unless a specific cyber extension has been added
  • Consequential loss beyond the nominated indemnity period

Does a liability waiver mean I don't need public liability insurance?

No. Section 139A of the Australian Consumer Law lets recreational service providers limit liability for injury with properly worded terms, but it cannot exclude gross negligence, and state-based Fitness Industry Codes still apply alongside it. A waiver reduces exposure, it doesn’t replace insurance.

Does gym insurance cover personal training or nutrition advice?

Physical injury claims are handled under Public Liability. Financial loss from negligent advice, such as a program or nutrition recommendation that causes harm without a physical incident, sits under Professional Indemnity, a separate section.

Does my policy cover injury from faulty gym equipment?

Generally yes under Public Liability, provided the gym was negligent, for example if staff knew equipment was broken and didn’t act. It generally won’t respond if the equipment was working properly and the injury happened because a member misused it or ignored safety instructions. Equipment sold or supplied in Australia, including treadmills and exercise cycles, must meet mandatory Australian safety and labelling standards, and poor maintenance can affect how a claim is assessed.

Does a standard gym policy cover unstaffed 24-hour access?

Typically no. Operating with unstaffed hours is a material change to the risk the insurer is taking on, and needs to be disclosed. Some policies exclude unstaffed hours entirely unless specifically extended to cover them, so this is worth confirming directly rather than assumed.

Does business interruption cover a forced closure?

Yes, where the policy includes business interruption cover, for events like fire or major equipment breakdown. Cover for closures ordered under a public health direction depends on the specific policy wording, so this is worth confirming rather than assumed.

Do I need product liability if I sell supplements or retail items?

Yes. Products Liability covers claims if something sold or provided on-site causes harm or triggers a complaint after it leaves the gym’s control, separate from the Public Liability section.
