Occurrence vs Claims-Made: Why Timing Matters
Products liability policies are written on an occurrence basis, meaning the policy in place when the damage actually happened is the one that responds, even if the claim is made years later. This matters for fabricators specifically, since structural failures don’t always show up straight away. If a weld or a fabricated component fails years after a project is completed, whether you’re protected depends on the policy you held at the time, not necessarily the one you hold today.

Public Liability Insurance
Covers you if your work causes injury to a third party or damage to their property, such as an incident during on-site installation or a visitor injured in your workshop. This is the cover most builders and site principals will ask to see evidence of before you start work.
Products Liability Insurance
Covers claims arising from a defect in something you’ve fabricated, if it fails after it leaves your workshop and causes damage or injury. This matters for this trade specifically, since a fabricated bracket, beam or structural component can fail well after installation, sometimes years later, regardless of how well the physical fabrication work was carried out.
Tools, Plant and Equipment Insurance
Covers your tools, machinery and equipment against loss, theft or damage, whether in your workshop or on site. Most policies only respond to theft where there’s evidence of forced or violent entry.
Machinery Breakdown Insurance

Professional Indemnity Insurance
Relevant if you provide design input, shop drawings or specifications as part of your work, separate from the physical fabrication itself. A products liability claim responds to a fabrication defect; a professional indemnity claim responds to an error in the design or specification behind it.

- Faulty Workmanship: The cost of rectifying faulty workmanship under public or products liability.
- Own Product Damage: Damage to your own product before it reaches a third party.
- Employee Claims: Claims by employees sit with workers compensation instead.
- Registered Motor Vehicles: Claims involving a registered motor vehicle sit with commercial motor cover instead.
- Undisclosed Hot Works: Undisclosed hot works or high-risk activities, if not properly declared to your insurer.
Is public liability insurance compulsory for steel fabricators in Australia?
No state legislates it directly for this trade, but in practice you won’t get a subcontractor agreement signed without it. Head contractors and builders treat proof of cover as a standard condition before work starts, and most tender documents specify a minimum limit.
Do I need products liability cover if I fabricate structural steel?
Yes, if there’s a chance your fabricated product could fail or cause damage after it leaves your workshop. This is separate from the liability cover that responds while you’re actively working on site.
Does my policy cover machinery breakdown?
Only if you’ve arranged machinery breakdown cover specifically. This is worth considering for workshops with significant plant such as CNC or laser cutting equipment, particularly where replacing that equipment would take weeks or months.
Do I need professional indemnity insurance as a fabricator?
It becomes relevant the moment you’re advising on design or specification, not just building to someone else’s drawings. If your input on a shop drawing or a connection detail turns out to be wrong, that’s a professional indemnity claim, not a products liability one.
